Welcome to GonnaLand ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the GonnaLand mobile application (the "App") and our website located at www.gonnaland.com (the "Site").
Please read these Terms carefully before using the App. By creating an account, accessing, or using GonnaLand, whether as an aircraft owner, pilot, or passenger, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App or Site.
1. Description of Service
GonnaLand provides a mobile platform designed for aviation pilots, aircraft owners, and passengers. The platform allows pilots and owners to configure aircraft profiles, upload media (such as cockpit and exterior photos), and share aircraft configurations by tail number. The App utilizes this information to enhance the passenger flight experience and provide contextual orientation and emergency guidance instructions.
2. Aviation Safety and Emergency Disclaimer
CRITICAL NOTICE: GONNALAND IS AN AUXILIARY INFORMATIONAL TOOL ONLY. IT IS NOT A CERTIFIED AVIATION SYSTEM, FLIGHT INSTRUMENT, OR AN ALTERNATIVE TO PRIMARY IN-FLIGHT EMERGENCY EQUIPMENT AND OFFICIAL EMERGENCY CHECKLISTS.
Pilot in Command (PIC) Authority: The Pilot in Command of an aircraft is solely and directly responsible for, and is the final authority as to, the operation and safety of that aircraft under Federal Aviation Administration (FAA) regulations or equivalent local civil aviation authorities. GonnaLand does not replace, override, or supplement the legal duties or decision-making of the PIC.
Passenger Guidance: Emergency guidance provided within the App is for educational and situational awareness purposes only. It relies entirely on user-submitted data and automated processing. There is no guarantee that the guidance provided is accurate, current, complete, or free of errors. In an actual emergency, users must follow the directions of the PIC, use official aircraft flight manuals (POH/AFM), and coordinate with Air Traffic Control (ATC) where possible.
Assumption of Risk: Aviation carries inherent risks, including the risk of injury or death. By using the App, you explicitly acknowledge and assume all risks associated with the operation or occupancy of an aircraft utilizing GonnaLand.
3. User Accounts and Eligibility
Eligibility: You must be at least 18 years of age to create an account as a pilot or aircraft owner. Passengers using the App must do so under the direct supervision of an adult account holder or pilot.
Account Security: You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Accuracy of Information: Pilots and owners agree to provide accurate, current, and complete information regarding aircraft configurations, avionics, tail numbers, and emergency procedures. We assume no responsibility for errors resulting from inaccurate or outdated user-submitted data.
4. User-Generated Content and Media License
You may upload photos, videos, text, and technical data related to your aircraft (collectively, "User Content").
Ownership: You retain ownership of any intellectual property rights you hold in your User Content.
License to Us: By uploading User Content, you grant GonnaLand a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and modify your content solely to operate, promote, improve, and develop the App.
AI and Machine Learning Training: This license explicitly includes the right for GonnaLand to use uploaded photos, data, and metadata to train, test, or fine-tune artificial intelligence and machine learning models to improve feature accuracy and the overall user experience.
Tail Number Data Sharing: You acknowledge and agree that aircraft configuration data and cockpit photos organized under a specific aircraft tail number may be made visible to other registered pilots or owners who search for or enter that same tail number. This is designed to simplify setup for shared, club, or rental aircraft.
5. Monetization and Advertisements
The App may include third-party advertisements, sponsorships, and promotional links, particularly within the passenger-facing experience. GonnaLand is not responsible for the content, products, or services offered in third-party advertisements. Your interactions with advertisers found on or through the App are solely between you and the advertiser.
6. Prohibited Conduct
You agree not to use the App to:
- Upload malicious code, viruses, or software intended to disrupt the App's functionality.
- Impersonate any person or entity, or falsely state your credentials as a licensed pilot.
- Register aircraft tail numbers for which you do not have authorized rental, ownership, or pilot-in-command access.
- Attempt to reverse-engineer, decompile, or extract the source code of the App or its underlying AI models.
- Use the App for any illegal or unauthorized purpose under applicable local, national, or international aviation regulations.
7. Intellectual Property
The App, Site, and all original content (excluding User Content), features, and functionality — including logos, software code, user interface designs, and AI assistance logic — are and will remain the exclusive property of GonnaLand and its licensors.
8. Limitation of Liability and Indemnification
Disclaimer of Warranties
GONNALAND IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR SAFETY REQUIREMENTS, BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GONNALAND, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to defend, indemnify, and hold harmless GonnaLand and its licensees from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) resulting from: (i) your use and access of the App; (ii) your violation of any term of these Terms; or (iii) any inaccurate, misleading, or hazardous information uploaded or configured by you under an aircraft profile.
9. Termination
We reserve the right, without notice and in our sole discretion, to terminate or suspend your account and access to the App for conduct that we believe violates these Terms, harms other users, or violates applicable aviation or civil law.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in California.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice via the App or our Site prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised Terms.
